The decision by the Grand National Assembly of Turkey (Türkiye Büyük Millet Meclisi, “TBMM”) to establish a Parliamentary Commission to determine steps to harness the benefits of artificial intelligence, develop the legal framework in this area, and identify measures to mitigate the risks associated with the use of artificial intelligence, was published in the Official Gazette dated October 5, 2024, and numbered 32683, thereby entering into force.
According to the decision, the commission will consist of 22 members, and its working period will be limited to three months, starting from the date of the election of the Chairperson, Vice Chairperson, Spokesperson, and Clerk. Pursuant to Articles 98 of the Constitution and 104 and 105 of the Rules of Procedure, the commission tasked with conducting the parliamentary inquiry may, if necessary, carry out its activities outside Ankara.
The commission aims primarily to address the dimensions of artificial intelligence related to personal data security, transparency, ethical values, and legal regulations. It will also focus on how artificial intelligence can be utilized more actively and effectively across different disciplines.
The commission’s work is expected to serve as a milestone and provide guidance for future legislative efforts. The sensitivity of the subject, especially regarding legal regulations related to the judiciary, holds particular importance. Specifically, considering that the fundamental principle in criminal justice is “moral conviction,” the question of whether artificial intelligence can possess moral conviction is regarded as highly significant.
